HEAR DIRECTLY FROM THANKFUL CLIENTS

I can’t thank Andres Rico enough for the incredible job he did on my case. Thanks to his dedication and sharp legal skills, I ended up getting less time than I expected, and he even got a misdemeanor charge dropped that I picked up while waiting for sentencing. That outcome was better than I could’ve hoped for, and it’s all thanks to him going the extra mile.

Assuming no accidents, injuries, or aggravating factors, a first-offense DUI case in Sonoma County is typically charged as a misdemeanor. Local Sonoma County prosecutors tend to offer the following upon acceptance of a guilty plea:

  • Approximately 2 days in county jail (generally work release or time served)
  • Three years of informal probation
  • $1900-$2500+ in fines/assessments
  • Three-month DUI school term
  • Six-month license suspension (with a restricted license available)

For a basic first DUI offense with no aggravating factors, this is considered the “standard” or “baseline” sentence handed down in most courts. Penalties are enhanced for higher BACs, test refusals, and/or drivers involved in accidents or who have prior convictions.

A criminal protective order comes from a criminal court and is designed to protect an alleged victim or witness of domestic violence (known as Protected Persons) from threats, harassment, or abuse by a defendant. You must remain away from the alleged victim’s home, the witnesses’ homes, or the victim’s/witnesses’ schools or workplaces. Be prepared to surrender weapons and ammunition in your possession, as well.

You can request a trial by written declaration and present your case in writing.

Some misdemeanor and certain felony convictions may be eligible for expungement after you complete probation. Expungement does not restore firearm rights, but it can improve employment opportunities.
